These terms and conditions (the “Website Terms of Use”), together with the documents referred to in them, tell you the terms of use on which you may make use of our website, www.plymouthstrategy.org ( the “Website”) and any other sub-domains of cpdportal.org. 

Please read these Website Terms of Use carefully before you start to use our website, as these terms of use will apply to your use of the Website, whether or not you choose to register with the Plymouth Secondary Strategy Portal. 

By using our Website, you confirm that you accept these terms of use and that you agree to comply with them. If you do not accept these Website Terms of Use, you must not use our Website. 

These Website Terms of Use refer to the following additional terms, which also apply to your use of our website:

The Website is a site operated by In-Finity Solutions a trading arm of In-Finity Literacy Ltd ("We"). 


We may revise these Website Terms of Use at any time by updating this posting. You should check the Website (www.plymouthstrategy.org) from time to time to review the then current Terms of Use, as they are binding on you. Certain provisions of these Website Terms of Use may be superseded by expressly designated legal notices or terms: (a) located on particular pages at the Website; or (b) notified to you, from time to time. 

We may update our Website from time to time and may change the content at any time. However, please note that any of the content on our Website may be out of date at any given time and we are under no obligation to update it. 

We do not guarantee that our Website, or any content on it, will be free from errors or omissions.

While we endeavour to ensure the Website is available 24 hours a day we do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or part of our website without notice. We will not be liable to you if for any reason our website is unavailable at any time or for any period. 

You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them.
 

 

4. Intellectual property rights

 

In-Finity Solutions is the owner or the licensee of the intellectual property rights on our website and in the materials published on it. You must not modify the copies of any materials that you have printed off or downloaded in any way.

All intellectual property, including page layouts, navigational layouts, event booking, directory, logo and branding lies with In-finity Solutions . All Enhancements to the site's core extensions remain solely the property of In-Finity Solutions.

In-Fintiy Solutions owns the copyright to the content listed on Plymouth Secondary Strategy Portal's following pages:  System Leader Directory, School Improvement and Team SW pages. The CPD event content submitted to the Plymouth Secondary Strategy Portal (e.g. content promoting an event, event description and logos) remains the copyright of the CPD Provider Organisation.

Our status (and that of any authorized contributors) as the authors of content on our website must always be acknowledged. 

You must not use any part of the content on our website for commercial purposes without obtaining a licence to do so from In-Finity Solutions first. 

 


5. Limitation of liability

 

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether expressed or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence) breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: 

Use of, or inability to use, our website; or
Use of or reliance on any content displayed on our Website.
We will not be liable for: 

Loss of profits, sales, business or revenue;
Business interruption;
 Loss of anticipated savings;
 Loss of business opportunity, goodwill or reputation; or

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to you downloading any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our Website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
 

6. Rights you license

Other than personally identifiable information, which is covered under our Privacy Policy, any material that you transmit or post to the Website shall be considered non-confidential and non-proprietary. When you upload or provide such material, you grant us and our partners a perpetual, worldwide, non-exclusive, royalty-free licence to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

You are responsible for configuring your information technology, computer programmes and platform in order to access our Website. You should use your own virus protection software. 

You are prohibited from posting or transmitting to or from the Website any material:  

that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence or in breach of privacy; or
for which you have not obtained all necessary licences and/or approvals; or
which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or
which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
You may not misuse the Website (including, without limitation, by hacking).

You acknowledge that we will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of this section.
 

 

8. Third party links

Links to third party websites on the Website are provided solely for your convenience. If you use these links, you leave the Website. We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the website, you do so entirely at your own risk.
 

9. Event ‘Bookers’

The Plymouth Secondary Strategy Portal is a “self-service” platform where Event Bookers can book their attendance on events. When you book onto an event directly, your commercial agreement is entirely with the event provider. CPD Portal does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

If you have any questions about an event, booking, refunds, data privacy or terms and conditions please contact the Event Provider directly. You may also find contact details for them in the same place you found the original link for their event (e.g. their website, Facebook page, or Twitter account).

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, or you have invited team members to access parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. You should reset your password periodically; you can do this by logging in and resetting your password. Your password should be unique and not a derivative of an existing one. 

As an Event Booker you are subject to the Plymouth Secondary Strategy Portal's Privacy Policy and Terms and Conditions, and by using the service you accept the terms and conditions. 

10. CPD Event Providers 

The Plymouth Secondary Strategy Portal is a “self-service” platform where CPD Event Providers manage their own event listings, and customer bookings entirely. When you book onto an event directly your commercial agreement is entirely with the event provider. The Plymouth Secondary Strategy Portal does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

When you (as an Event Organiser) use the Plymouth Secondary Strategy Portal for promoting events and collecting data from your attendees you are the “data controller” of all your attendees’ data. The Plymouth Secondary Strategy Portal is a “data processor”, which means that the Plymouth Secondary Strategy Portal won’t do anything with your attendees’ data other than what you need the the Plymouth Secondary Strategy Portalto do in order to provide the service. The Plymouth Secondary Strategy Portal will not send attendees any marketing emails or share their data with anyone. 

The Event Organiser is responsible for the security and their GDPR compliance in the use of any data exported from the Plymouth Secondary Strategy Portal and should adhere to their own organisation's policy and practice. 

The Plymouth Secondary Strategy Portal cannot be held responsible for any data breach relating the mishandling of data / data exported from the system by an Event Organiser. 

The Plymouth Secondary Strategy Portal provides the ability for Event Organisers to email event delegates directly through the system (This is a feature of the Tier 2 Subscription). This functionality has been designed to send service related (operational) emails specific to an Organiser's event attended by the recipient of such email. If an Organiser wants to use this function for marketing purposes, you (the Organiser) need to secure your own compliant opt-in consents for the sending of marketing emails. Each event provides event attendees with the option to set their communication preferences.

If  an event attendee/booker should have any questions about an event, booking, refunds, data privacy or terms and conditions they should contact the event organiser directly via the ‘Contact’ menu, selecting the provider they wish to contact. They may also find contact details for them in the same place they found the original link for their event (e.g. their website, Facebook page, or Twitter account).

As an Event Organiser you are subject to the Plymouth Secondary Strategy Portal's Privacy Policy and Terms and Conditions, and by using the service you accept the terms and conditions as well as your responsibilities as a data processor. 

If you wish to report misuse of the system or you suspect a fraudulent event listing please send the details via the contact form and include a link to the event.

10.1 Event Deletion 

In order to avoid having to restore your events after deletion and introducing an overhead, we don't currently provide this functionality. Instead of deleting a event you  can 'Unpublish' the event and it will be hidden. If you require the event permanently deleted from the platform we can of course delete it for you. Please contact us if you require an event deleted. 


10.2 Event Expiry

Events where the end date has expired will be removed from the platform. Once they have been deleted from the system it is not possible to recover them.  

Please contact us if you wish to retain an expired event before the event’s end date.
 

 

11. Canceling a subscription order

Subscription orders for the Plymouth Secondary Strategy Portal are placed directly with In-Finity Solutions are processed immediately and can only be canceled by contacting the Plymouth Secondary Strategy Portal Lead. If you decide you no longer wish to use or retain access to the service to which you've subscribed, you must contact us to request cancellation within 30 days of the subscription expiry date (the expiry date is 12 months from the date the subscription was taken out). Failure to inform the Plymouth Secondary Strategy Portal Lead you wish to cancel within the agreed time will result in you being billed for the next year’s membership.


11.1 Access to Data

You will have access to files uploaded to your account and your events for 30 days after the subscription end date. After 30 days, your account will be disabled and become inaccessible and all your events will be deleted from the platform.  


11.2 Subscription Renewal

Your subscription automatically renews when your contract expires to ensure you have continuous access to the platform (You will be invoiced 60 days before your renewal date). You will be charged for a new subscription term on the renewal date listed in the ‘My Subscriptions’ menu. 

You can cancel the automatic renewal within 30 days of your renewal date by contacting our Help Desk. You will retain access to the platform and its services until the renewal date but will not be automatically charged for a new subscription if you fail to inform us you wish to cancel. Access to the platform and any services will end on your subscription renewal date.
 

11. Applicable law

These terms of use, its subject matter and its formation (and any non-contractual dispute or claim) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

12. Community Rules of Conduct

A professional learning community is a vibrant, ever-changing group of connections to which educators go to both share and learn. These groups reflect our values, passions, and areas of expertise. The purpose of the Community is to voluntarily exchange information and provide an environment for peer support. 

You expressly agree not to use any part of the Community to:

	•	post content that is unlawful, malicious, misleading, defamatory, harmful, threatening, abusive, harassing, vulgar, obscene, libelous, objectionable, inappropriate, improper, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
	•	impersonate any person or entity, including, but not limited to,  Plymouth Strategy Portal  or an an  Plymouth Strategy Portal  employee, or falsely state or otherwise misrepresent your affiliation with any person, group or entity;
	•	forge headers or otherwise manipulate identifiers in order to disguise the origin of any content submitted to any part of the Community;
	•	post any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
	•	post any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights or rights of publicity or privacy rights of any third party;
	•	post any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
	•	post any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
	•	act illegally or unethically or use for any illegal or unethical purposes;
	•	intentionally or unintentionally violate any applicable local, state, national or international law, rule, regulation or policy, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law; or
	•	collect or store personal data about other users.

You are solely responsible for the content of your computer and any transmissions you make when using the Community. Posts on any part of the Community may be edited, moved, deleted or removed at any time and for any reason or no reason and without notice by any  Plymouth Strategy Portal  employee or representative. The Plymouth Strategy Portal is not obligated to provide you with any reason or explanation for any post being edited, moved, deleted or removed. There is no means of appeal for any post or membership that is edited, moved, deleted or removed from the Community.  Plymouth Strategy Portal reserves the right to temporarily or permanently withdraw Community membership at any time and for any reason or no reason.  Plymouth Strategy Portal  is not obligated to provide you with any reason or explanation for any such membership withdrawal.
Plymouth Strategy Portal does not guarantee a response to any post on the Community. Specifically, support issues should be addressed via  Plymouth Strategy Portal 's official support provisions and protocols. You understand that posts on the Community are addressed to your peers and not Plymouth Strategy Portal  and  Plymouth Strategy Portal  does not guarantee that any support issue will be addressed on the Community.

Plymouth Strategy Portal  does not make any warranty or guarantee that any information posted on any part of the Community, whether or not such posting is made by an  Plymouth Strategy Portal  employee, is accurate, complete or in anyway reliable. Any support issues or questions about  Plymouth Strategy Portal  should be addressed via  Plymouth Strategy Portal 's official customer support provisions and protocols.  Plymouth Strategy Portal  disclaims any approval or liability related to any comments made on the Community by a user or third party. Community Forum posts represent the statements and opinions of the individual third-party users and are not necessarily the opinion of  Plymouth Strategy Portal  or its employees, partners and affiliates.  Plymouth Strategy Portal  does not approve or disapprove of any Community Forum post.
Limitation of Liability/Indemnity/Disclaimer of Warranties

THE COMMUNITY AND ALL INFORMATION, SERVICES AND DOCUMENTATION PROVIDED IN CONNECTION WITH ANY PART OF THE COMMUNITY ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
PLYMOUTH STRATEGY PORTAL SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING INDIRECT, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT PRODUCTS OR SERVICE, OR LOSS OR DAMAGE TO INFORMATION OR DATA ARISING OUT OF THE USE OR INABILITY TO USE ANY PART OF THE COMMUNITY OR THE RELIANCE ON ANY INFORMATION CONTAINED ON ANY PART OF THE COMMUNITY. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL  Plymouth Strategy Portal  BE LIABLE FOR DAMAGES RESULTING FROM USE OF ANY PART OF THE COMMUNITY, OR RELIANCE ON THE INFORMATION PRESENTED IN ANY PART OF THE COMMUNITY OR IN CONNECTION WITH ANY PART OF THE COMMUNITY, EVEN IF STRATEGY PORTAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ALL DISCLAIMERS AND LIMITATIONS SET FORTH IN THESE TERMS OR OTHERWISE EXISTING AT LAW (1) ARE OF THE ESSENCE OF THE AGREEMENT OF THE PARTIES, AND (2) SURVIVE ANY TERMINATION, EXPIRATION OR RESCISSION OF THESE TERMS.

Plymouth Strategy Portal  does not offer formal customer support on the Community.  Plymouth Strategy Portal  employees or representatives may post on the Community, but this activity should not be seen as a replacement for the official  Plymouth Strategy Portal  support procedures and provisions. The goal of the Community is to provide a platform for  Plymouth Strategy Portal  registered users who wish to exchange information .  Plymouth Strategy Portal  has the right, but not the obligation, in its sole discretion, to pre-screen, refuse, move, remove or delete any submissions for any reason or no reason whatsoever and without any notice. You agree that you must evaluate, and bear all risks associated with the use of any information, including any reliance on the accuracy, completeness, or usefulness of such information, including any information that may be posted by any Plymouth Strategy Portal  employee.  Plymouth Strategy Portal 's provision of the Community should in no way be construed as endorsement or approval of any third-party product, service, comment, position or information that may be mentioned or referred therein or any of the comments or posts made by any individual or third party.
The purpose of the Community is to voluntarily exchange information and provide an environment for peer support. You agree to indemnify, defend and hold harmless  Plymouth Strategy Portal  and its officers, directors, employees, owners, information providers, agents, partners, affiliates, licensees, licensors from and against any and all liabilities, demands, claims, costs, including reasonable attorneys' fees, incurred by the indemnified parties in connection with any demand, claim, action, suit, or loss due to or arising as a result of any breach by you of these Terms of use or claims arising from your account or arising out of content you submit, post, transmit or make available through the Community, your use of the Community, your connection to the Community, your violation of any agreement with  Plymouth Strategy Portal ,  Plymouth Strategy Portal 's Legal Notices and Terms of Use,  Plymouth Strategy Portal 's Privacy Policy and these Terms, or your violation of any rights of any third party. You agree to use your best efforts to cooperate with Plymouth Strategy Portal  in the defense of any demand, claim, action or suit.  Plymouth Strategy Portal  reserves the right to assume the exclusive defense of any matter subject to indemnification by you at  Plymouth Strategy Portal 's own expense.

You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify  Plymouth Strategy Portal  of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.  Plymouth Strategy Portal  cannot and will not be liable for any loss or damage arising from your failure to maintain the confidentiality of your access credentials.

13. Webinar Video Recording and Publication Consent 

By participating in an online webinar event, you agree to authorise recording of audio and visual content presented during the live event and consent to subsequent use of the recording in the public domain by the provider presenting the live webinar, unless otherwise stated by the provider.
